Landmark Judgment on Abortion Right of Unmarried Woman: X v. The Principal Secretary, Health & Family Welfare Department Govt. of NCT of Delhi & Anr [SLP] (C) No. 12612 passed on 29.09.2022

This is the historical Judgment on abortion right of unmarried women. In this case, the Supreme Court permitted unmarried women for abortion up to 24 weeks. The Court held that “all unmarried & single women have the exact same right to safe & legal abortion up to 24 weeks as married women. The Court further declared that exclusion of unmarried women from 20-24 weeks gestation period under the MTP Rules to be arbitrary & unconstitutional”. The Court further held that Abortion is a reproductive fundamental right & cannot be denied by any doctors or hospital.

Landmark Judgment on Abortion Right of Minor Girl: S v. Union of India & Ors Special Leave Petition [SLP] (C) No. 14454 passed on 24.04.2026

This is another historical Judgment on abortion right of Minor girls. In this case, the Supreme Court permitted a minor girl aged 15 years to terminate her unwanted pregnancy of 31 weeks. It also held that “No court can compel a woman, especially a minor, to carry an unwanted pregnancy to term against her will”.

Landmark Judgment on Abortion Right of Married women facing change in Marital circumstances: Mrs B. v UOI & Ors W.P (C) No. 13371 of 2023

This is also a landmark judgment on abortion right of married women facing change in material circumstances & permitted abortion at 24 weeks. The High Court of Delhi held that “it is the prerogative of each woman to evaluate her life & arrive at the best course of action in view of the change in material circumstance which may result when a woman separates from her partner & she may no longer have the financial resources to raise the child & also in view of the fact that the right to reproductive choice also includes the right not to procreate”.

Landmark Judgment on clashing of both MTP Act & POCSO Act: K. v. The Principal Secretary Health & Family Welfare W.P (C) No. 13479 of 2022

The High Court of Delhi allowed the minor to terminate her pregnancy & held that there is need to maintain harmonious balance between both the MTP & POCSO Act.

Landmark Judgment on Abortion Right of Minor & masked her identity: N. v. The Principal Secretary Health & Family Welfare W.P (C) No. 291 of 2023

The High Court of Delhi held that the identity of the minor should not be disclosed while reporting the matter by the doctors/hospital to the concerned authorities under section 19 (1) POCSO Act.
